Welcome to Medwin. By accessing or using our mobile application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
1. Educational Purpose and Medical Disclaimer
MEDWIN IS AN EDUCATIONAL TOOL AND DOES NOT PROVIDE MEDICAL ADVICE.
The Service, including all AI-generated patient scenarios (OSCEs), flashcards, multiple-choice questions (MCQs), and medical tools, is intended solely for the educational purposes of medical students and healthcare professionals in training. The content provided through the Service is not a substitute for professional medical judgment, diagnosis, or treatment. You must never rely on Medwin for clinical decision-making or patient care.
2. Account Registration
To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for safeguarding your password and for all activities that occur under your account.
3. Subscriptions and Payments
Medwin offers both free and premium subscription tiers (e.g., Medwin Pro, Medwin Max).
- Billing: Premium subscriptions are billed on a recurring basis. By choosing a premium tier, you authorize us or our third-party payment processors (such as Paystack, Apple App Store, or Google Play) to charge your payment method for the subscription fee.
- Cancellations: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing cycle. We do not provide refunds for partial months of service unless required by law.
- Usage Limits: Certain features (like AI usage, MCQs, and document uploads) are subject to limits based on your subscription tier. We reserve the right to enforce these limits to ensure fair usage across all users.
4. User Content and AI Processing
You may upload documents, notes, and other materials to the Service ("User Content"). You retain all intellectual property rights to your User Content. By uploading User Content, you grant Medwin a temporary, non-exclusive license to process, analyze, and store this content for the sole purpose of providing the Service to you (e.g., generating flashcards).
AI Generated Content: You understand that Medwin uses artificial intelligence to generate practice scenarios and educational content. While we strive for accuracy, AI-generated content may sometimes be inaccurate, incomplete, or misleading. You are responsible for verifying any medical information against authoritative medical resources.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any local, state, or international law.
- Upload any content containing Protected Health Information (PHI) or real patient data. The Service is not HIPAA-compliant and is not intended for the storage of patient records.
- Attempt to reverse-engineer, decompile, or hack the Service or its underlying AI models.
- Share your account credentials or attempt to bypass subscription limitations.
6. Intellectual Property
The Service, including its original content (excluding User Content), features, functionality, and design, are owned by Medwin and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.
7. Termination
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Medwin and its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) any reliance on AI-generated educational content.
9. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
